Project 113 – Sexual offences

The ALA made a submission in response to the WA Law Reform Commission’s (‘the Commission’) consultation on the Law of Consent.

Our submission focuses on the question of whether WA should adopt an affirmative consent model in defining consent for the purpose of sexual offences under the Criminal Code Compilation Act 1913. This model has been adopted in NSW, Victoria, the ACT and Tasmania.

In February this year, ALA Spokesperson on Criminal Justice, Greg Barns attended a session on the Commission’s consultation, where he demonstrated the benefit of flexibility in the current WA and Queensland definitions of consent.
