Aviation Consumer Protections – primary legislation
3 October 2025
The ALA made a submission to the Department of Infrastructure, Transport, Regional Development, Communications, Sport and the Arts, relating to the Aviation Consumer Protections – primary legislation.
In our submission, the ALA welcomed the move to a stronger, enforceable aviation consumer framework but argued that costs should be absorbed by airlines, not passengers, and that ACO jurisdiction clearly extends across ACL, Montreal Convention, and CACL complaints, including inbound flights.
The submission also called for a simple statutory flight-delay compensation scheme to ensure fair, transparent remedies while excluding complex personal injury claims from the ACO’s scope
