National Disability Insurance Scheme Amendment (Securing the NDIS for Future Generations) Bill 2026 (the Bill)

The ALA has provided a submission to the Senate Community Affairs Legislation Committee on the National Disability Insurance Scheme Amendment (Securing the NDIS for Future Generations) Bill 2026. The submission has since been published.
The Bill proposes changes to NDIS eligibility, reassessment, plan management, treatment requirements, planning decisions, and the interaction between the NDIS and workers’ compensation and CTP schemes.
In its submission, the ALA supported the objective of ensuring the long-term sustainability and integrity of the NDIS, but raised concerns that the Bill may reduce eligibility, entitlements and procedural protections for people with permanent disability.
The ALA’s key concern is proposed section 25B, which may exclude people from the NDIS where their impairment arises from a workplace injury or motor vehicle accident. The ALA submitted that existing laws already prevent duplication between the NDIS and compensation schemes, and warned that the Bill risks removing the NDIS safety net from vulnerable participants based solely on the cause of their injury.
On 23 June 2026, the Senate agreed that the Community Affairs Legislation Committee table an interim report for the Bill.
