Overview
Ted Dohrmann and Craig Sidebottom will discuss practical and evidential issues that should be considered prior to lodging a claim alleging injury over the course of employment.
Musculoskeletal (strain) injuries often arise over the course-of-employment. They are usually more complex to investigate and understand rather than the specific incident cases which also cause strain injury. Often there is a history of repetitive, sustained or awkward work done by your client over the course of their employment; the details of which should rightfully be considered to fully appreciate and expand the extent of employer liability.
Careful investigation of the systems of work are needed from the outset to identify the precise problems, and build the liability argument. Ted will share his views as an expert asked to investigate and provide opinion on dozens of such matters in Victoria and other jurisdictions. He will discuss the types of questions that you should be asking your client in these sorts of matters to properly comprehend the issues. He will also discuss the circumstances where a worker should rely upon a specific event in conjunction with a course of employment argument.
A practical interview checklist for these type of matters will be provided to attendees.
Craig will provide his thoughts as to what other practical matters a lawyer should consider prior to recommending the pursuit of a compensation claim, including when to pursue an impairment claim and when to directly lodge a claim for common law damages.
