A healthy and safe working environment: wishful thinking or a heavy handed approach under the new Work Health and Safety Act 2020 (WA)
Western Australia’s harmonised safety legislation was passed on 10 November 2020 but has not yet taken effect. The regulations are expected to be ready by the end of the year with an effective start date of 1 January 2022. This is about a decade after most of the rest of Australia moved to the harmonised model.
The Act has many new features which essentially widen the scope of the Act and the powers of inspectors. This includes moving away from the employment relationship as the basis for the duty of care; positive due diligence obligations on directors and the introduction of industrial manslaughter. The State Government has provided the regulator with more funds in an attempt to make it more effective. It is expected that the increased criminalisation of this workplace sector will address more ‘psycho-social’ or ‘health-related hazards’ such as bullying and sexual harassment in the workplace.
This will be an informative briefing session and you will have the opportunity to ask questions.
