Webcast - Expert Evidence Masterclass series 2023

Overview

Following the success of our Expert Evidence Masterclass in 2022, the ALA is presented an Expert Evidence program with a focus on providing information not solely for lawyers but also for expert witnesses. The expanded program was conducted over two mornings: 9 and 30 August 2023. The masterclass series covered the essential elements of Expert Evidence but also focused on particular issues.

Part 1 focused on:

  • the expertise of the witness and capacity of an expert to go beyond their expertise;
  • the form of the report and why the form is important;
  • the interaction that is appropriate between lawyers and the expert prior to the completion of the report;
  • the role of the expert before the court and the obligation of the expert to provide documents under subpoena to the court;
  • the approach an expert should take to cross examination;
  • the rules about engagement with the parties; and
  • the role of the experts at conclaves.

Part 2 focused on:

  • the interaction with lawyers and other experts after reporting;
  • disclosing of draft reports or lawyers notes of opinion;
  • updating memoranda and supplementary reports;
  • the conclaves process including questions for experts, the facilitator and the scribe;
  • preparation and communication during and after conclaves;
  • the final report and admissibility of discussions not in the report; and
  • evidence at trial including objections to evidence, evidence-in-chief and cross­examination.
