Overview

Jurisprudence relating to section 9 of the Civil Liability Act 2003 (s305B WCA) and its interstate counterparts continues to emerge from appellate courts across Australia. Understanding the operation of these provisions, and identifying the areas still to be resolved by the courts, is critical to the Australian tort lawyer’s everyday practice.

This Masterclass will cover duty and breach in the contexts of work related injury, public liability, motor vehicle cases, survivor litigation, and medical and professional negligence. These areas will be divided into categories across the two sessions.

To It is highly recommended that attendees register for both sessions to gain the full benefit of the Masterclass.

Speakers

Richard Douglas QC, Callinan Chambers

Richard was appointed Queen’s Counsel in 2013. He practises in Queensland and interstate in civil trial and appellate advocacy, with associated advisory practice.

His areas of speciality are insurance, common law and statutory liability, commercial law, commercial vendor and purchaser law, real property and statutory confiscation of criminal profits. He has a particular expertise in statutory proportionate liability in economic loss and property damage cases.

He has appeared in many of the leading cases construing the MAIA/WCRA/PIPA pre-procedural and Ipp civil liability legislation of Queensland.

Geoffrey Diehm QC, Jeddart Chambers

Geoffrey Diehm QC commenced practice as a barrister at the Brisbane bar in 1991. He practices in health law, insurance and personal injuries law, public and administrative law, commercial law and succession law. He has regularly appeared in federal and state superior courts as well as the Land Court, the Coroners Court and various tribunals.

He has extensive experience representing hospitals, medical practitioners and other health care providers in civil proceedings, administrative proceedings including disciplinary proceedings, and in inquests. He has appeared for clients in a number of Commissions of Inquiry. He regularly acts for and advises governments and agencies of government, corporations, insurers and individuals in a wide range of matters.

Gerard Mullins, Barrister, Darrow Chambers

Gerard Mullins is a barrister from Queensland. He was admitted to practice in 1988 and has practised at the private bar since that time.

He has a Bachelor of Laws from the Queensland University of Technology (QUT) and a Master of Laws from the University of Queensland. He lectured and tutored in tort law in the Bachelor of Law course at QUT between 1991 and 1998 and also lectured in the Masters program at QUT.

He has served as a part-time member of the Queensland Anti-Discrimination Tribunal and was Chair of the Australian Consumer Law Committee of the Law Council of Australia between 2009 and 2011.
