 NDIS, NIIS and Catastrophic Injury - Developing Issues

Overview

The management of catastrophic injury claims occurring from 1 July 2016, both in the rehabilitation and common law damages phase, involves engagement with the Queensland version of the National Injury Insurance Scheme and interaction with the NDIS is also often necessary. Case law is now emerging in this new area.

Our stable of speakers includes experienced practitioners in catastrophic injury including Richard Douglas QC, Geoff Diehm QC, Gerard Mullins, Rod Hodgson and Meghan Rothery. We also have experienced Occupational Therapist Erin Pavy to discuss the management of catastrophically injured clients and their interaction with NIIS and NDIS.

Geoffrey Diehm QC

Hemmant's List

Geoffrey Diehm QC was admitted to the Bar in 1991. He took silk in 2008.

He holds an LLB and an LLM from the Queensland University of Technology.

He practices in health law, insurance and personal injuries law, public and administrative law, commercial law and succession law. He has regularly appeared in Federal and State superior courts as well as the Land Court, the Coroners Court and various tribunals.

He has extensive experience representing hospitals, medical practitioners and other health care providers in civil proceedings, administrative proceedings including disciplinary proceedings, and in inquests. He has appeared for a variety of clients in a number of Commissions of Inquiry. He regularly acts for and advises governments and agencies of government, corporations, insurers and individuals in a wide range of matters.

He is an experienced trial and appellate counsel and has been involved in very many mediations, as well as having acted as a mediator and an arbitrator.

Richard Douglas QC
Callinan Chambers

Richard was admitted to the Bar in 1980 and commenced practice in 1982 after working as a law clerk in Townsville, NQ. In 1998 he was appointed Senior Counsel in and for the State of Queensland. In 2013 he was appointed Queen’s Counsel. He practises in Queensland and interstate in civil trial and appellate advocacy, with associated advisory practice. He is a member of Hemmant’s List.

His areas of specialty are insurance, common law and statutory liability, commercial law, commercial vendor and purchaser, real property and statutory confiscation of criminal profits. He has a particular expertise in statutory proportionate liability in economic loss and property damage cases.

Rod Hodgson

Rod Hodgson is a Managing Principal at Maurice Blackburn. He leads the firm’s Queensland practice, which is the largest of its type in Australia. Rod is based in Brisbane and travels regularly to our other Queensland offices. He has been listed by the prestigious Doyle's Guide as a workplace compensation lawyer of note, and says the most rewarding thing about being a lawyer is “making a positive difference”. Rod was presented the Queensland Law Society Outstanding Achievement Award in 2017 for his impact on the community and in legal circles over many years.

Rod has also been responsible for many law-changing and leading cases, and he has been following and contributing to policy development and oversight on National Disability Insurance Scheme (NDIS) and the National Injury Insurance Scheme (NIIS) since they were first mooted some time ago.


Gerard Mullins

Gerard Mullins is a barrister from Queensland. He was admitted to practice in 1988 and has practised at the private bar since that time.

He has a Bachelor of Laws from the Queensland University of Technology (QUT) and a Master of Laws from the University of Queensland. He lectured and tutored in tort law in the Bachelor of Law course at QUT between 1991 and 1998 and also lectured in the Masters program at QUT.

He has served as a part-time member of the Queensland Anti-Discrimination Tribunal and was Chair of the Australian Consumer Law Committee of the Law Council of Australia between 2009 and 2011.

Erin Pavy

Erin Pavy founded Integrate Rehab with a strong focus on case management for people with significant disability and assisting families and clients to plan for their future. This includes determining short term and long-term care, accommodation, equipment, treatment and rehabilitation options and costs. I work closely with solicitors, trustee companies and financial advisers to develop a unique, practical report to provide clients with peace of mind that their financial plan reflects their complex needs.

My role with a major trustee company has facilitated excellent knowledge of the legal and regulatory framework within which allied health professionals, servicing the catastrophically injured, are required to work.

I have extended my services through the launch of Age at Home Australia, assisting individuals to remain at home for as long as is safely possible and providing choices through information and support.

Meghan Rothery

Meghan Rothery is a Principal Lawyer at Maurice Blackburn and a member of the Serious Injury Team (QLD). She has seven years of experience as a lawyer and is the firm’s Regional Office Leader based in Rockhampton. Meghan grew up on a property just outside the small rural town of Wowan, an hour’s drive south of Rockhampton, and studied at the University of Queensland and Queensland University of Technology in Brisbane. Meghan cut her legal teeth on commercial law in Rockhampton from 2006, before joining Maurice Blackburn in 2012.

Since joining the firm, Meghan has quickly taken on extra leadership responsibilities and often appeared in the local media commenting on issues that matter to people in Central Queensland, including road safety and workers’ rights.

Greg Spinda became the Queensland President in July 2018, prior to which he was the Queensland Secretary for about two years. He has been a member of the ALA for 13 years.

Greg is an experienced personal injury compensation Senior Associate in Maurice Blackburn’s Brisbane office. He helps people throughout the greater Brisbane area with compensation claims and associated legal advice related to workers’ compensation, road accident compensation and public liability claims.

After graduating with a Bachelor of Laws and Bachelor of Business Management from the Queensland University of Technology, Greg gained experience in a small Queensland firm before joining Maurice Blackburn in December 2017.
