Webcast- Lessons from LATAM: Claiming compensation for air travel accidents

Overview

LATAM Airlines Flight 800 recently made world headlines after it suddenly plummeted over 90m while en route from Sydney to Auckland, injuring 50 passengers, of whom 13 were sent to hospital.

Join barrister and Qantas airline pilot Damien Toohey and the ALA’s resident travel compensation expert Victoria Roy for a webinar on personal injury claims arising from incidents such as this.

We’ll examine the LATAM incident itself, along with:

• Turbulence (what it is, can it be avoided)

• Procedures for medical incidents on flight including factors to consider for flight diversions

• Documents like manuals and reports to subpoena (because you don’t know what you don’t know)

• Passenger transits

You’ll come away with a better understanding of compensation claims for injuries sustained in the course of air travel, and hear real-life experience, insights and insider tips from an active pilot.

Speakers

Damien Toohey was called to the Bar in 2019 and became a qualified mediator in 2022.

He focuses his practice in Criminal defence, Estate matters encompassing Family Provision and contested Wills, Family Law and Workers Compensation claims. Damien has a particular interest in Aviation Law, specifically in responding to Show Cause Notices, conferences with CASA, attending reviews in the AAT, and for the more serious matters, appearing in Coronial Inquests.

Damien’s passion for Aviation Law stemmed from his career as an international pilot with Qantas where he ultimately operated the Airbus A380. Recently, he has re-qualified as an airline pilot and is trained, once again, on the A380.

Damien’s legal background is in Personal Injury litigation, comprising over 10 years in Workers Compensation, Motor Vehicle and Medical Negligence for both parties.

In 2022, Damien became a qualified mediator with Resolution Institute of Australia. He is available to accept briefs to act as a private mediator in Aviation disputes, Commercial disputes, Personal Injury ‘shuttle style’ mediation, and Estate mediation.

Damien brings a conciliatory approach to his practice as a Barrister and as a Mediator, with an emphasis on justice between parties.

Victoria Roy founded Victory Travel & Cruise Lawyers in 2021 after working in personal injury and travel law for 12 years. Before establishing her own firm, Victoria led the travel law practice group at a top Sydney personal injury firm for 4 years.

Victoria’s vision is to make justice accessible to all injured travellers. By founding a small tech-savvy firm focusing on one area of law, she provides expert legal advice at a competitive rate compared to general personal injury firms.

Victoria brings over a decade of experience to her files as well as thorough preparation of cases which results in excellent outcomes for her clients.

As well as being a leader in her field, Victoria understands that seeing a lawyer can be intimidating. She therefore makes it her mission to put clients at ease from the first meeting, because to get the best results a client needs to be comfortable with their lawyer.
