Collaery charges are concerning

The Australian Lawyers Alliance (ALA) has expressed concern at the decision to file criminal charges against ACT lawyer, Bernard Collaery.

“We note Mr Collaery is contesting the charges and we are not commenting on the evidence in the case,” said Greg Barns, criminal law spokesperson, ALA.

“However, we need to remind ourselves that many lawyers around Australia, acting in the best interests of their clients and justice, make available materials that may embarrass governments or expose wrongdoing. It is right and proper that they continue to do when circumstances require.

“Lawyers play a vital role in ensuring that the right to freedom of speech is protected in our democracy. We give voice to the truth when it is inconvenient and that must also continue to be our role.

“The right to legal representation is a core element of a democratic society based on the rule of law. These charges undermine that principle.”

The ALA supports Mr Collaery.
