Achieving greater consistency in laws for financial Enduring Powers of Attorney

The ALA’s Elder Law SIG has made a submission to the Attorney-General’s Department on addressing financial elder abuse and achieving greater consistency in laws for financial Enduring Powers of Attorney (EPOAs).

Since EPOAs are made under state and territory law, this is a national consultation process which has been endorsed by the Standing Council of Attorneys-General.

The ALA’s submission responds to the Consultation Paper released by the Attorney-General’s Department, including in relation to: Decision-making capacity, the execution of EPOAs, and the obligations on witnesses.
