Government response to the Privacy Act Review Report 2023

The ALA has made a submission to the Attorney-General’s Department providing feedback on the Government’s response to the Privacy Act Review Report, released on 16 February 2023.

The Report deals with data breaches including Optus and Medibank incidents; making 116 key recommendations based on themes contributed by stakeholders over the last two years.

Our submission supports a number of key recommendations including the creation of a direct right of action and a statutory tort for serious invasions of privacy; mandatory reporting requirements; a right of erasure that creates a right to request the deletion of personal information by APP entities; tightening the timeframe for reporting eligible data breaches to the OAIC; additional protections for children and vulnerable persons; and a host of new civil penalties and new powers for the OAIC.
